Regulatory framework

 

In accordance with the amended Data Protection Act of January 6, 1978, and the General Data Protection Regulation (EU Regulation 2016/679 of April 27, 2016), LA FRENSH processes the personal data of its customers and prospects, here- after mentioned as Customer data and Prospect data.

Type of data collected

 

The Customer and Prospect data collected by LA FRENSH may be the following: surname, first name, title, email address, date of birth, postal address and delivery address, telephone number. LA FRENSH also reserves the right to collect browsing data through the use of cookies, which may include geolocation data, in accordance with the legislation in force. 

The cookie is a computer file stored on the hard disk of the Customer's microcomputer. Its purpose is to report a previous visit by the Client or Prospect to the site.  la-frensh.fr The Customer may deactivate the use of cookies by selecting the appropriate settings on their browser, however such deactivation may prevent the use of certain features of the site.  la-frensh.fr

Regarding the data of minors, LA FRENSH undertakes not to create a customer account for a person under the age of 16.

Purposes of processing

This customer and prospect data is collected by LA FRENSH as part of its activities in order to ensure the award, management and execution of rentals or purchases, the creation and management of the customer account, the management of the loyalty program, commercial prospecting, needs assessment by personalizing the customer journey with segmentation and/or profiling actions, then, carrying out statistical studies.

Recipients

 

The recipients of the data are the customer services, e-commerce marketing of LA FRENSH, as well as a payment provider (KLARNA), the company providing the maintenance of the system and the host of the site.  la-frensh.fr  (IONOS). Data transfers with our service providers are governed contractually and according to the law in force, and are subject to an adequate level of data security.

Conservation

 

In accordance with the retention principle of the General Data Protection Regulations, and with simplified standard 48 for the management of customer and prospect files, personal data relating to customers cannot be kept beyond the retention period strictly necessary for the management of the commercial relationship.  

 

LA FRENSH undertakes to delete or archive Customer data after a period of 3 years following the last purchase, and Prospect data after a period of 3 years following the last interaction.

Exceptions are the data necessary to establish proof of a right or a contract which may be archived, as provided for by the provisions of the Commercial Code relating to the retention period of the books and documents created on the occasion commercial activities, and the Consumer Code relating to the retention of contracts concluded electronically.

Rights of the data subject

 

The Client or Prospect has a right to access and rectify the data concerning him, and can also assert his right to erasure or right to be forgotten, as well as his right of opposition or right to portability. . On the other hand, the Client or Prospect can deactivate the use of cookies at any time, by selecting the appropriate parameters of his browser. However, such deactivation may prevent the use of certain features of the la-frensh.fr site.

Finally, any Client or Prospect has the right to lodge a complaint with the competent supervisory authority (in France, this is the CNIL) concerning the processing of their personal data.

Lawfulness of processing

 

The provision of Customer data is necessary for a purchase or a subscription on the la-frensh.fr site, in particular for the delivery of the order to the customer. The collection of Prospect data is based on the legitimate interest of the data controller. Finally, the processing of data by LA FRENSH may respond to a legal obligation (taxation or management of litigation, for example).
